Welcome to Baluk arts, an online store showcasing authentic Indigenous artworks. By accessing or purchasing from this website, you agree to the following terms and conditions.

1. About Us

Baluk Arts supports and represents First Nations artists and communities by selling artworks that reflect their cultural heritage. All artworks are sold with artist permission and, where appropriate, community consent.

2. Purchasing Artworks

  • Authenticity Guarantee: All works are original and created by Aboriginal and/or Torres Strait Islander artists. Certificates of authenticity may accompany artworks where applicable.

  • Product Descriptions: We strive to ensure all images, dimensions, and descriptions are accurate, but minor variations may occur.

  • Pricing: All prices are in $AUD. GST, where applicable and Shipping costs are calculated at checkout.

  • Order Confirmation: An email confirmation will be sent once your order is placed. We reserve the right to refuse or cancel any order.

3. Payment

We accept payments via Visa, MasterCard, PayPal – Payment must be received in full before your order is dispatched.

4. Shipping and Delivery

  • Domestic Shipping: Orders within Australia are shipped on a weekly basis via Australia Post and typically arrive within 7–14 business days.

  • International Shipping: Shipping outside Australia may incur additional customs fees and longer delivery times.

  • Insurance and Responsibility: Responsibility for goods passes to the buyer upon delivery. Insurance is recommended for valuable pieces.

5. Returns and Refunds

Due to the unique nature of the artworks, returns and refunds are only accepted for damaged goods or errors in order fulfillment.

  • Claims must be made within 7 days of receiving your order.

  • Return shipping for approved claims will be covered by us.

  • We do not offer refunds for change of mind.

6. Intellectual and Cultural Property

  • All artworks and images are protected by copyright and may not be copied, reproduced, or used without explicit written permission from the artist and/or the gallery.

  • We honour the cultural rights of Aboriginal and Torres Strait Islander artists. Purchasing an artwork does not grant the right to reproduce the image in any form, including digital.

7. Privacy

Your personal information is collected solely for order processing and customer service. We do not sell or share your information with third parties, except where required to fulfill your order.

8. Cultural Disclaimer

Some artworks may contain images or references to deceased persons. We strive to include warnings where applicable and welcome your feedback in maintaining cultural sensitivity.

9. Governing Law

These terms are governed by the laws of Victoria. Any disputes shall be resolved in accordance with Australian consumer law.
